1. Acceptance of Terms

By accessing or using oakhealthplans.com (the "Website"), you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Website.

Oak Health Plans may update these Terms from time to time. Material changes will be posted with a new "Last Updated" date. Continued use of the Website after changes are posted constitutes your acceptance of the revised Terms.


2. Who We Are

Oak Health Plans is an independent, licensed insurance agency based in Princeton, Texas. We are not an insurance company, the federal or state Health Insurance Marketplace, Medicare, or any government agency, and we are not affiliated with or endorsed by HealthCare.gov, CMS, or any state exchange.

We work with a limited number of insurance carriers and may not offer every plan available in your area. For a full list of all Qualified Health Plan options, you may contact HealthCare.gov or 1-800-318-2596, or your state's Marketplace, and this listing is free of charge.

When you enroll in a plan through us, Oak Health Plans (or the licensed producer you worked with) will typically be listed as your agent of record, but the insurance contract is between you and the carrier. Coverage, claims, premiums, and benefits are governed solely by the policy documents issued by that carrier — not by these Terms.


3. Scope of Services

Oak Health Plans provides education, plan comparisons, quoting, and enrollment assistance for:

ACA Marketplace (Qualified Health Plan) coverage

Private/off-exchange major medical and PPO plans

Dental and vision plans

Life insurance

Group benefits

We do not provide medical, legal, tax, or financial advice, and nothing on this Website should be treated as such. You are solely responsible for reviewing plan documents, evaluating your options, and deciding which plan (if any) meets your needs. Enrollment in any plan is subject to the carrier's underwriting, eligibility rules, and approval — Oak Health Plans does not guarantee acceptance, pricing, or coverage terms.

If you have questions about an active claim, billing, or plan benefits after enrollment, contact your carrier directly using the number on your insurance card, or reach out to us and we will assist where we can as your agent.


4. Eligibility

You must be at least 18 years old to use this Website or request a quote. By using the Website, you represent that you meet this requirement and that any information you submit is accurate and your own (or that you are authorized to submit it on behalf of a dependent or covered person).


5. Consent to Contact (Calls, Texts, and Email)

By submitting your phone number or email address through this Website — including via any quote request, chat, or contact form — you expressly consent to be contacted by Oak Health Plans, its agents, and representatives at the number(s) and email address(es) provided, including by:

This consent applies even if your number is on a state or federal Do-Not-Call registry, and is not a condition of purchasing any product or service. You may revoke consent at any time by replying "STOP" to any text message, asking a representative to stop calling during any call, or emailing [email protected]. 6. Your Information & Privacy

We collect certain personal and contact information you provide (such as your name, phone number, email, and information relevant to insurance quoting). We do not sell your personal information.

Service providers who help us operate the Website and our business (such as our CRM/marketing platform, hosting provider, and email/SMS delivery services), who are only permitted to use your information to provide services to us

If you request or complete a plan application or related document through the Website, you agree that your electronic submission and any electronic signature constitutes your legal signature and consent to conduct business electronically, to the extent permitted by the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and applicable state law.


11. Disclaimer of Warranties

The Website and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement.

Oak Health Plans does not guarantee that plan information, pricing, or availability displayed on the Website is current or error-free — carriers change rates, networks, and plan availability without notice. Always confirm final terms directly with the carrier or your agent before relying on any figure shown on the Website.

Not all products or services may be available in every state; availability depends on our current licensing and carrier appointments.


12. Limitation of Liability

To the fullest extent permitted by law, Oak Health Plans and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of, or inability to use, the Website, or from any plan, product, or service obtained through it. This limitation does not apply where prohibited by law, and nothing in these Terms limits liability for gross negligence, willful misconduct, or fraud.

Our total liability arising out of your use of the Website, for any cause whatsoever, is limited to the greater of (a) $100, or (b) the amount, if any, you paid directly to Oak Health Plans for the Website itself (excluding premiums paid to carriers).


13. Indemnification

You agree to indemnify and hold harmless Oak Health Plans, its officers, employees, and agents from claims, damages, liabilities, and reasonable expenses (including attorney's fees) arising from your violation of these Terms, your misuse of the Website, or your submission of false or misleading information.


14. Third-Party Links

The Website may link to third-party sites (e.g., carrier portals or HealthCare.gov). Oak Health Plans does not control and is not responsible for the content, security, or privacy practices of third-party sites. Use of those sites is at your own risk and subject to their own terms.


15. Governing Law

These Terms are governed by the laws of the State of Texas County of Collin, without regard to its conflict-of-law principles.


16. Dispute Resolution

Informal Resolution First: Before filing any claim, you agree to contact us at [email protected] so we can attempt to resolve the issue informally.

Arbitration: If a dispute isn't resolved informally within 30 days, any claim arising out of or relating to these Terms or the Website will be resolved by binding arbitration administered by the American Arbitration Association (AAA)under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.

Venue: Arbitration will be held in Collin County, Texas, or another mutually agreed location, or may be conducted by phone or in writing where permitted by AAA rules.

Class Action Waiver: Disputes will be resolved on an individual basis only. You waive any right to participate in a class, collective, or representative action, to the extent permitted by law.


17. Termination

We may suspend or terminate your access to the Website at any time, for any lawful reason, including violation of these Terms.

No Waiver: Our failure to enforce any provision is not a waiver of that provision or any other.

Assignment: You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
